These Terms of Use govern your use of BiomedExchange. By using the site, you agree to these Terms. If you do not agree, do not use the site.
What BiomedExchange does
BiomedExchange is an independent index of medical, dental, veterinary, laboratory, and related equipment offered by third-party dealers and auctioneers. We are not an auction house, broker, dealer, or seller. We do not take possession of equipment, process a purchase, or hold buyer funds.
Each listing links to its source. Any inquiry, quote, bid, purchase, payment, shipping arrangement, warranty, return, or other transaction is between you and the applicable dealer or auctioneer. BiomedExchange is not a party to that transaction.
Unless a dealer page is marked as claimed, the dealer has not claimed that page through BiomedExchange. References to dealers, auctioneers, manufacturers, products, and trademarks do not imply endorsement, sponsorship, or affiliation.
Listing information
Listing details can change after we last check the source. We do not independently inspect equipment or verify its identity, ownership, condition, safety, availability, price, location, regulatory status, or fitness for a particular use. Confirm all material facts with the seller before acting.
An FDA database reference means only that the stated manufacturer and model matched a public database record when checked. It does not verify the particular unit, establish its current regulatory status, or certify that it is safe or suitable for clinical use.
The site and its content are provided on an "as is" and "as available" basis. To the extent permitted by law, BiomedExchange disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
Requests for quotes and seller submissions
An RFQ is recorded when you submit it. If you choose to share it, the service may attempt to send it to matched dealers that have a usable contact address. Delivery and a dealer response are not guaranteed. The confirmation shown after submission states what happened for that request.
If you submit equipment through the seller-intake flow, you represent that the information is accurate and that you own the equipment or are authorized to offer it. A submission does not create a listing agreement, consignment, brokerage, or agency relationship, and does not guarantee publication, a buyer, a price, or a sale.
Accounts and permitted use
You are responsible for activity through your account and for keeping access to your email secure. You may use the site to browse, compare, save, submit, claim, correct, or remove information through the features provided.
You may not:
- use the site unlawfully or to misrepresent your identity, authority, or eligibility to buy regulated equipment;
- submit patient-identifiable information or other protected health information;
- interfere with the site, bypass access controls or rate limits, or probe it for vulnerabilities;
- use automated means to access or extract site content except for standard search-engine crawling that follows our robots.txt; or
- copy or use site content in a way that infringes another person's rights.
We may restrict access or remove submitted material when reasonably necessary to operate or protect the service or respond to a valid request.
Ownership and third-party content
BiomedExchange owns or licenses the site's software, design, and original text. Product facts, dealer information, third-party trademarks, and linked source material remain subject to the rights of their respective owners. See the Attribution & Corrections Policy and Copyright Policy.
Liability
To the extent permitted by law, BiomedExchange is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenue, arising from use of the site, a listing, an RFQ, an auction, or a third-party transaction.
Some laws do not allow particular warranty exclusions or liability limits, so parts of these sections may not apply to you.
Changes
We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively from the posted effective date.
Listing and account requests
Use the relevant site flow to report a correction from the applicable listing page, claim a dealer page, or request removal of listings. Signed-in users can manage available account features from the dashboard.
